if it’s not being worn properly the cop can give a ticket …
but it depends on how nice/anal the officer is
if he was not wearing the seatbelt correctly then yes he can get a ticket for that. chances are the cop didn’t see him even wearing the seatbelt cause it was under his arm and not over and that’s prolly why he got pulled over the first place. the cop doesn’t know if you husband just put it on or not all he saw was no seatbelt.
If he wasn’t wearing it properly then yes, he can get a ticket.
it all depends on how nice the police officer who pulled you over is
Weird. I could see how he could get pulled over for it, but that cop is hardcore. I guess he could.
probably depends on the state, i just got a speeding ticket but before i got pulled over i discreetly put on my seatbelt and the best way was under the arm….all i got was the speeding ticket and he didnt say anything about the seatbelt i live in florida
Seat belt violations are not usually subject to discussion or interpretation. If one does not have it secured properly, one can be flagged. Having the shoulder restraint tucked under the arm negates the effectiveness of the entire belt and the upper torso can really take a beating in the event of a crash. Hubby knows better now.
If it’s under his arm- he’s not wearing it in the proscribed manner.
There’s no such thing as half wearing a seatbelt, so yes, he wasn’t wearing it.
It depends on the laws in the state in which you live. I believe in most states the law makes no distinction as long as the belt is on. Remember, we haven’t had the shoulder part of the belt all that long.
Yes
Yep..I got 1 for doing the same thing.
I have a feeling the officer could have given a warning… if he wanted to. Your husband could go to court and fight the ticket, after all it is the judge who makes the official ruling, not the officer. Keep in mind that if the judge rules against your husband, court costs will be incurred in addition to the fine.
Yes must be worn properly
Any time a seatbelt is worn incorrectly or improperly can result in a citation for seatbelt violations. Wearing a 3 point passive restraint seatbelt without the shoulder strap in it’s correct position can cause serious if not fatal injuries should the person be involved in an accident. The cop may have saved your husbands life that day, you never know when an accident will occur.
After 7 tickets for that same reason, I would say YES! To stop getting seat belt tickets, I now drive a 1965 ford pickup.
Yes you can…
Yes you can get a ticket for that, but why would you wear it that way in the first place?
Yeah, they can give a ticket for that. Had your husband got into an accident, having the seat belt under his arm, he could have really gotten badly hurt. Depending on the force and how strong it is, he could easily gotten something severed, or broke bones, or something worse. So to make sure people will wear it properly, he gives a ticket, in case this kind of thing happens.
first of all who’s disputing the under arm part? if it’s fastened around your waist that’s all the law states. after that it’s a matter of proof, his word against yours. go to court and it will be dismissed Im sure there were other charges/ tickets involved?
I cannot believe police officers have nothing better to do with their time than give seat belt citations. Especially seat belts being incorrectly worn. Someone needs to give them something to do…..
